General terms and conditions

The consumer has the right to notify Yourbeerexperience that he/she cancels the purchase, without having to pay a fine and without stating a reason, within 14 days from the day following the delivery of the product.

If the ordered products do not meet the Customer's expectations, the Customer may return the unopened and undamaged goods or bring them into the shop within 14 days of receipt, without having to give a reason and without paying any penalty, provided that the delivery note or invoice is presented. We will refund or exchange the returned items. Yourbeerexperience will bear the costs of the return and (possible) new shipment.

Yourbeerexperience will under no circumstances accept opened bottles or jars that have been returned.

ARTICLE 1: GENERAL PROVISIONS

The electronic web shop of Yourbeerexperience, a Trappist bar with its head office in Herselt (Belgium), offers its customers the opportunity to purchase Trappist products online. The present General Terms and Conditions ("Conditions") apply to all articles from the Yourbeerexperience range and every purchase made by the customer from Yourbeerexperience. The customer accepts that these terms and conditions alone shall apply, to the exclusion of their own general or specific (purchasing) terms and conditions, even if these stipulate that they alone shall apply.

ARTICLE 2: PRICE

All prices stated always include VAT and all other taxes that the customer is required to pay. If transport, reservation or administrative costs are charged, this will be indicated separately. The price stated refers exclusively to the articles as described word for word. The accompanying photo is for decorative purposes only and may contain elements of articles not included in the price.

ARTICLE 3: OFFER

All offers are only open to customers residing in the European Union. The articles are intended exclusively for normal private use.

Despite the fact that the catalogue and website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up to date. If you have specific questions about, for example, sizes, colours, availability, delivery times or methods, we request that you contact our customer service department first (see article 12).

Yourbeerexperience is only liable for the accuracy, up-to-dateness or completeness of the information provided. Yourbeerexperience shall under no circumstances be held liable for material errors, misprints or printing errors. The offer is valid while supplies last and can at all times be modified or withdrawn by Yourbeerexperience.

Yourbeerexperience is entitled to refuse orders, adjust delivery deadlines, split deliveries or attach other conditions to delivery without stating any reasons.

ARTICLE 4: ONLINE PURCHASES

The client has the option of purchasing items from the Yourbeerexperience range online. The purchase is made when the client receives a confirmation email from Yourbeerexperience. The items are delivered to the customer's home on the delivery date stated in the confirmation email. The customer has the choice between the following payment methods: - via credit card - cash.

Yourbeerexperience accepts payments by Bancontact, VISA and MASTERCARD. If the Client chooses to pay by credit card, the amount will be debited from their account immediately upon confirmation of payment.

ARTICLE 5: RETENTION OF TITLE

The delivered items remain the exclusive property of Yourbeerexperience up until the moment of full payment by the customer. The risk of loss or damage is transferred to the customer upon delivery. The client commits to informing third parties of Yourbeerexperience's retention of title when necessary, for example to anyone who might seize items not paid for in full.

ARTICLE 6: SANCTIONS FOR NON-PAYMENT

Without prejudice to the exercise of other rights held by Yourbeerexperience, the client shall be liable for interest of 10% per annum on the unpaid amount from the date of default, and without prior warning. Furthermore, the client owes, automatically and without warning, a fixed compensation of 10% on the amount involved, with a minimum of € 25 per invoice. Without prejudice to the above, Yourbeerexperience reserves the right to take back items not (fully) paid for.

ARTICLE 7: COMPLAINTS

Any visible damage and/or qualitative shortcomings of an article or other shortcomings in the delivery must be reported immediately, on pain of forfeiting any rights.

ARTICLE 8: GUARANTEE

  1. Legal guarantee (only for consumers)

Under the Act of 21 September 2004 on the protection of consumers in respect of the sale of consumer goods, the consumer has legal rights. Each article is subject to the legal warranty from the date of purchase by (or delivery to) the first owner. Any commercial guarantee leaves these rights intact.

  1. General

To make a claim under the guarantee, the client must be able to present proof of purchase. For items purchased online and delivered to the customer's home, the customer must contact customer services in advance after which the customer must return the item to Yourbeerexperience at their own expense. The (commercial and/or legal) guarantee never applies to defects caused by accidents, neglect, falls, abnormal or incorrect use, use of the item contrary to the purpose for which it was designed, failure to comply with the user instructions or manual, adjustments or modifications to the item, heavy-handed use, poor maintenance, abnormal or incorrect use. It is also not applicable to articles with a shorter lifespan, or wear items. Defects that become apparent after a period of 6 months following the date of purchase, or delivery if applicable, are not considered to be hidden defects, unless the Customer can prove otherwise. The guarantee is not transferable.

ARTICLE 9: RENUNCIATION PERIOD

The provisions of this article only apply to customers who purchase items online in their capacity as consumers: The consumer has the right to notify Yourbeerexperience that they are cancelling the purchase, without having to pay a penalty and without stating a reason, within 14 days of the day following the delivery of the product. Customers wishing to exercise the right of withdrawal must contact customer services within 14 days of delivery and return the goods at their own expense within 20 days of delivery to Yourbeerexperience; steenovens 26, 2230 Herselt, Belgium. Goods with a sales price of 100 Euro or more must be returned to us by courier (PostNl, Bpost, DHL, Fedex, etc). Only articles that are in their original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned. Under no circumstances will the following articles be taken back:

- used, dirty, damaged or incomplete articles
- articles of which the packaging (or part of the packaging) has been opened
- articles that have been custom-made for the customer
- articles that, by their nature, cannot be returned

ARTICLE 10: PRIVACY

Yourbeerexperience undertakes to use your details solely for the purpose of executing the agreement you entered into through your order and to send you non-committal information from Yourbeerexperience. If you would also like to receive information by e-mail, please provide your e-mail address. We treat your details as confidential information and will never pass them on, rent or sell them to third parties. You may at any time request, correct, change or delete your details kept in the Yourbeerexperience customer list and you may also refuse to allow Yourbeerexperience to use your details to send you information. It suffices to make a written request to the address below: Steenovens 26, 2230 Herselt. The client is responsible for keeping his log-in details confidential and for the use of his password. Your password is stored encrypted, Yourbeerexperience has no access to it. Yourbeerexperience strictly observes the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal details. Through your user profile you have access to all the information available on Yourbeerexperience for consultation, modification or deletion. Yourbeerexperience makes use of cookies. Cookies consist of a standard Internet technology that makes it possible to store and unlock certain information on the user's system. Cookies cannot be used to identify individuals; a cookie can only identify a machine. Every Internet user can set his computer in such a way that cookies are not accepted. If your computer does not accept cookies, it is possible that you will experience problems during the ordering process. Should this be the case, please contact us so we can still enter your order. Yourbeerexperience keeps online (anonymous) visitor statistics to see which pages of the website are visited and to what extent. ARTICLE 11: IMPAIRMENT OF VALIDITY - NON-RENUNCIATION

If any provision of these Conditions is declared invalid, unlawful or void, this will in no way affect the validity, legality and applicability of the other provisions. Failure at any time by Yourbeerexperience to enforce one of the rights listed in these Terms and Conditions, or to exercise any of these rights, shall never be seen as a renunciation of such a provision and shall never affect the validity of these rights.

ARTICLE 13: AMENDMENT OF TERMS AND CONDITIONS

These conditions are supplemented by other conditions which are explicitly referred to and Yourbeerexperience's general terms and conditions of sale. In the event of a discrepancy, the present conditions shall prevail. Yourbeerexperience may amend these terms and conditions at any time without further notice. Any purchase made after the change constitutes acceptance by the customer of the new terms and conditions.

ARTICLE 14: PROOF

The customer accepts that electronic communications and backups may serve as evidence.

ARTICLE 15 - AGE LIMIT

Orders may only be placed with those who are 18 years of age or older. If it appears during delivery that the order is placed or delivered to someone under 18, the order will automatically be cancelled. The cost of this cancellation is €9.99 and will be borne by the consumer. So never let someone younger than 18 accept an order, the deliveryman will not deliver the order.
